Terms and Conditions

These Terms and Conditions (the “Agreement”) apply to all renovation, construction, and related services (“Services”) provided by 13974871 CANADA INC. (“WholeHome,” “we,” “us,” or “our”) to the client (“Client,” “you,” or “your”) as outlined in the signed project proposal, estimate, or contract (“Project Agreement”). By approving the Project Agreement and proceeding with the project, the Client agrees to be bound by these Terms and Conditions.

1. Scope of Work

  • The scope of work is defined exclusively in the Project Agreement and associated drawings, selections, and written change orders.

  • Verbal agreements, assumptions, or undocumented requests are not binding.

  • Any items not explicitly listed are excluded.
     

2. Pricing & Payment Terms

  • All pricing is based on the specifications and scope provided at the time of contract.

  • A deposit is required to secure scheduling. Remaining payments will be outlined in the Project Agreement and invoiced according to project milestones.

  • Payments are due upon receipt unless otherwise stated.

  • Late payments may result in paused work, rescheduling, or additional fees.

  • For projects exceeding $1,000, progress payments will be structured as follows, unless otherwise specified in writing:

    • 10% upon quote approval

    • 20% for product procurement

    • 30% at installation commencement

    • 30% at substantial completion

    • 10% upon final walkthrough

  • By paying the deposit, the Client acknowledges responsibility for ensuring all outstanding balances are paid within 30 days of invoice issuance.
     

2.1 Estimates

  • Estimates are based on visible conditions only.

  • Estimates are subject to change based on approved finishes and alterations in the scope of work.

  • Estimates are valid for 30 days; after this period, pricing may be subject to change.

  • Should concealed or unforeseen conditions be discovered, additional charges may apply.

3. Scheduling & Timelines

  • Start dates and timelines are estimates and may change due to material availability, approved change orders, labour supply, subcontractor capacity, permitting, weather, or unforeseen site conditions.

  • WholeHome is not liable for delays outside of our control.

  • Client-caused delays may result in rescheduling fees and/or updated pricing.

  • If the Client delays the project for more than 30 days, updated pricing or rescheduling fees may apply.
     

4. Change Orders

  • Any change to the original scope must be requested in writing and approved via a signed change order.

  • Changes may affect pricing and timelines.

  • Work will not proceed on additional items until written approval and payment (if required) is received.
     

5. Client Responsibilities

The Client agrees to:

  • Provide safe and uninterrupted access to the property.

  • Remove personal belongings from work areas prior to project start, unless moving and storage services are provided in your scope of work during the project duration.

  • Ensure pets and children are kept clear of construction zones.

  • Make timely decisions to avoid delays.

  • Schedule site visits in advance; unannounced visits are not permitted due to safety and liability restrictions.
     

WholeHome is not responsible for damages to items not removed from the workspace.
 

6. Unforeseen & Pre‑Existing Conditions

  • Hidden, structural, electrical, plumbing, rot, asbestos, mold, or code‑related issues may require additional work and costs.

  • WholeHome will notify the Client before proceeding where possible.

  • Costs to remediate unforeseen conditions are the Client’s responsibility.
     

7. Permits, Inspections & Compliance

  • The cost of architectural or engineered drawings, permits, asbestos testing, and hazardous material assessments is not included in the estimate unless explicitly stated in writing.

  • Where required and included in the Project Agreement, WholeHome will obtain permits and schedule inspections.

  • If permits are excluded, the Client assumes responsibility for compliance.

  • Delays caused by municipal authorities are not the responsibility of WholeHome.
     

8. Materials & Product Selections

  • Material selections must be finalized by the Client by the required deadlines.

  • Delays in selections may affect schedule and pricing.

  • If products are discontinued or back‑ordered, WholeHome will assist in finding comparable alternatives.
     

9. Access, Utilities & Site Conditions

  • The Client must provide access to electricity, water, and washroom facilities for trades.

  • If temporary facilities or power are required, additional costs may apply.
     

10. Cleanup & Disposal

  • WholeHome will perform routine site cleanup and remove construction debris as part of the project.

  • Final professional cleaning is not included unless specified.
     

11. Warranty

  • WholeHome provides a 1-year workmanship warranty from the date of substantial completion, unless otherwise stated in writing.

  • Manufacturer warranties apply to supplied products.
     

11.1 Warranty Exclusions

Warranty does not cover:

  • Damage from misuse, wear and tear, maintenance neglect, or third-party work.

  • Natural variations in wood, stone, grout, or caulking.

  • Cracks, settling, or movement related to the structure or foundation.

  • Client-supplied materials, which are not covered under warranty.

  • Return site visits after completion will be billed at Time & Materials.
     

11.2 Warranty Claims

  • Warranty requests must be submitted in writing with photos.

  • A WholeHome representative must visually inspect and verify the issue for the claim to be valid.

  • WholeHome will assess and schedule repairs within a reasonable timeframe.
     

12. Subcontractors & Trades

  • WholeHome may engage qualified subcontractors to complete work.

  • All subcontractors operate under WholeHome’s standards and project management.
     

13. Damage & Liability

  • WholeHome carries commercial liability insurance and WCB/WorkSafe compliance.

  • WholeHome is not responsible for:

    • Pre‑existing conditions or damages

    • Delays caused by third parties or suppliers

    • Loss of use of space during construction
       

14. Project Completion & Deficiency Process

  • Substantial completion is reached when the project is usable for its intended purpose with only minor deficiencies remaining.

  • A deficiency list will be created and addressed within a reasonable timeframe.

  • Final payment is due upon substantial completion, not after all minor touch‑ups.
     

15. Cancellation, Refunds & Suspension

  • If the Client cancels the project after signing, costs for work performed, materials purchased, and scheduling may be deducted from any refund.

  • No refunds or discounts will be issued once work has commenced, except where required by law.

  • WholeHome may suspend work for non-payment or unsafe conditions.
     

16. Client‑Supplied Materials

  • WholeHome is not responsible for delays, defects, or warranty claims related to client‑supplied products.

  • Additional labour charges may apply for installation of client‑provided items.
     

17. Photos & Marketing

  • WholeHome may photograph completed work for marketing purposes.

  • Client identity and address will not be disclosed.

  • If the Client does not consent, they must notify WholeHome in writing before project start.
     

18. Dispute Resolution

  • WholeHome is committed to resolving concerns professionally.

  • In the event of a dispute, both parties agree to attempt resolution through written communication and mediation before legal action.
     

19. Governing Law

  • These Terms and Conditions are governed by the laws of the Province of British Columbia, unless the project occurs in another jurisdiction, in which case local laws apply.
     

20. Acceptance

By approving the Project Agreement, paying the deposit, or allowing work to begin, the Client acknowledges and agrees to these Terms and Conditions.
